1. Declaration
These ELive Terms of Service (hereinafter "Terms") govern your use of our services (hereinafter "Service"). You are a party to this agreement, and the other party is EFUN PTE. LTD., a company registered at 68 Circular Road, #02-01, Singapore 049422. In this agreement, both you and ELive are collectively referred to as "Parties," and individually as a "Party."
By using the Service or by clicking "Register" during the registration process, you agree to abide by the [ELive Privacy Policy] and any additional guidelines or rules provided within the Service. These rules may vary depending on the specific services and features you use. Some services may require payment, and you agree to abide by any additional terms or conditions related to those services disclosed to you.
By using the Service or registering, you agree to all terms in this agreement. We reserve the right to modify this agreement at any time. The current version will be published under App Settings > User Agreement. Continuing to use our services indicates your acceptance of the modified agreement.
2. Eligibility
Our services are only available to individuals 18 years or older. By using the Service, you declare and warrant that:
You are of the "Minimum Age" (defined below) or older;
You are not prohibited from using the Service by ELive.
Creating an account with false information, including registering on behalf of others or individuals under 18, is a violation of this agreement.
"Minimum Age" refers to 18 years. If the legal age for using the Service (including the use of your personal data) in your jurisdiction is higher than the Minimum Age, then the Minimum Age is the higher age.
You are responsible for the security of your ELive account and password. All activities performed through your account are considered your actions, and you are fully responsible for them.
We do not accept payments or transactions from individuals or entities located in Cuba, Iran, North Korea, Sudan, Syria, or Crimea. If you are from these regions, you may be prohibited from using ELive services.
3. Content Services
We strive to provide users with a wonderful platform,we offer the following services:
Recommended Content, Products, and Services
We display advertisements, promotional information, and other sponsored content to recommend products and services provided by businesses and organizations using ELive.
Global Services
To provide global services, we may store and distribute content and data across multiple data centers worldwide, including regions outside your country or area. These infrastructures may be operated or controlled by EFUN PTE. LTD..
4. User-Generated Content
We have strict review and management mechanisms for user-generated content (UGC), including:
Licensed Content
ELive allows users to post live-streaming content, text, images, audio, video, and other data or materials ("User Content") through the service. Users may also add special effects, stickers, virtual props, and other elements provided by ELive to create content.
Review and Processing
We have a professional team and advanced technologies to identify abuse of the service, harmful actions towards others, and situations requiring protection. For violating content or behavior, we will take appropriate actions, including but not limited to: providing help, deleting content, restricting or removing access to certain features, disabling accounts, or contacting law enforcement.
5. Account Management
When creating an account, you will need to provide necessary information, such as a username and password, and are responsible for the confidentiality of your account and all activities performed under it.
To delete your account, please contact us at service@elive.fans. Once deleted, your account and associated content cannot be restored.
6. Privacy Policy
We highly value user privacy. Please refer to our [Privacy Policy] to understand how we process your personal information and protect your privacy.
7. Service Usage Rules
You must comply with these Terms and applicable laws and regulations, and must not:
Upload, distribute, or engage in illegal, infringing, obscene, or harassing content;
Impersonate others, falsify identities, or obtain others' account information;
Abuse the service by uploading viruses, malware, or harmful software;
Interfere with the normal operation of the service or other users' experiences;
Use the service for illegal purposes or violate any applicable laws.
Violations of these rules may result in account suspension or termination.
8. Prohibited Content, Content Moderation, Complaints and Misuse
By using our Services, you acknowledge that we implement and utilize content moderation mechanisms, both automated and manual. We explicitly prohibit content falling within the following categories, as defined in our Community Guidelines ("Prohibited Content"):
Illegal Activity: Content promoting or facilitating illegal activities, including violence, terrorism, drug use, or hate crimes;
Hate Speech: Content that attacks a person or group on the basis of race, ethnicity, religion, nationality, disability, sexual orientation, gender identity, or other protected characteristics;
Harassment and Bullying: Content that threatens violence against an individual or group or that is intended to intimidate, threaten, or abuse another person. This includes cyberbullying and doxing;
Child Sexual Abuse Content (CSAM): Any content depicting the sexual abuse of a minor. We have zero tolerance for CSAM;
Violent threats: content that threatens violence against an individual or group;
Intellectual Property Infringement: Content that violates intellectual property rights, such as unauthorized streaming of copyrighted material;
Misinformation and Disinformation: Spreading demonstrably false or misleading information, particularly regarding public health or safety;
Spam and Malicious Content: Unsolicited commercial messages, phishing attempts, or malware distribution;
Promotion of Self-Harm: Content that encourages or glorifies self-harm or suicide.
You acknowledge and agree that to utilize and enjoy our Services, including viewing Content or utilizing other features, such as enabling you to upload or transmit Content through the Services or communicate with other users or broadcasters, you must adhere to the guidelines outlined in these Terms and our Community Guidelines. If you are a broadcaster, you are also required to adhere to our Broadcaster Terms.
ELive may, at its discretion, utilize automated, semi-automated tools, and human checks of Broadcast Content and Content. However, you acknowledge and agree that we may not be able to identify all Prohibited Content, and we make no warranties to you regarding any Broadcast Content or Content. We reserve the right, at our discretion and at any time, to remove, refuse to share, transmit, upload, display, or publish any material, content, or information provided by you or any Content for the purpose of enforcing these Terms or for any other reason deemed appropriate by us.
We encourage users to report any content that violates these Terms or our policies using the designated reporting tools within our Services.
9. Virtual Items
9.1 Definition and Use
Virtual items refer to digital goods that users purchase or acquire through the ELive platform, which are for use within the platform only and cannot be transferred, redeemed for cash, or exchanged for other physical items.
9.2 Ownership and Consumption
The ownership of virtual items remains with ELive, and users are granted a license to use them. Once purchased, virtual items are generally non-refundable, subject to platform policies.
9.3 Validity and Termination
Virtual items may have an expiration date. Please use them in a timely manner. If you breach the agreement or if the platform discontinues service, virtual items may become invalid, and ELive is not responsible for additional liabilities.
10. Payment Terms
We accept major credit cards, certain debit cards, and other payment methods available on our platform. By placing an order, you authorize us or our payment processor to charge the specified account. You agree to the terms of your chosen payment method.
Our payment partners may collect personal data for processing payments, as required by law, and may contact you directly regarding payment issues.
If a payment is declined, please verify your information and try again. For assistance, contact customer support at service@elive.fans.
i. In-App Purchases:
ELive may offer in-app purchases. Once confirmed, your payment method will be charged for the selected services.
ii. Auto-Renewal:
Subscriptions will automatically renew unless canceled. Your payment method will be billed until canceled.
iii. Payment Disputes:
For payment issues, contact customer support or your bank. You can cancel automatic payments but still owe any outstanding amounts.
iv. Subscription Changes:
To modify or cancel your subscription, go to ELive settings or the third-party account. Deleting the app does not cancel subscriptions.
v. Refund Requests:
Apple ID: Request a refund through Apple.
Google Play: Contact customer support.
Other platforms: Contact the merchant.
vi. Pricing:
ELive's pricing may vary by region, subscription, and promotions.
11. Intellectual Property
All content on ELive is protected by copyright and other intellectual property laws. Unauthorized reproduction, modification, or distribution is prohibited.
12. Termination of Services
We reserve the right to terminate or suspend your use of the service at any time, including but not limited to situations where you violate this agreement or legal provisions.
13. Disclaimer
ELive provides the service "as is" and does not make any guarantees regarding the service’s applicability, availability, or reliability.
14. Governing Law
This agreement is governed by the laws of Singapore, and any disputes should be submitted to the Singapore International Arbitration Centre for arbitration in accordance with its rules.
15. Information Requests
For legal requests for information or documentation, please submit your request to EFUN PTE. LTD. in accordance with legal procedures.
16. Agreement Modifications
We may modify this agreement due to service improvements or legal changes. Modified terms will be communicated through app notifications or other means. Continuing to use the service indicates your acceptance of the modified agreement.
17. Miscellaneous
This agreement constitutes the entire agreement between the parties, and the section headings are for convenience only and do not affect the interpretation of the terms. If any part of this agreement is deemed invalid, the remaining parts will remain in full effect.
